Welcome to alike (“alike”, the “Service”), a service operated by Off Diary Limited (“Off Diary”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your access to and use of alike, including our website, applications, hosted pages, custom domains, and any related services.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must:

  • have the legal capacity to enter into a binding agreement; and

  • comply with all applicable laws while using the Service.

You may not use alike if you are prohibited from doing so under applicable law.

2. The Service

alike is a platform that allows creators, businesses, and organizations to create hosted profile pages, mini websites, link-in-bio pages, storefronts, and similar online experiences.

Depending on your subscription, the Service may allow you to:

  • publish public profile pages;

  • upload text, images, videos, and files;

  • sell digital or physical products;

  • collect payments through Stripe;

  • collect email subscribers;

  • connect custom domains;

  • customize branding and appearance; and

  • manage your published content.

We may modify, improve, or discontinue features at any time.

3. Your Account

You are responsible for:

  • maintaining accurate account information;

  • protecting your password;

  • all activities that occur under your account.

You agree to notify us immediately if you become aware of unauthorized access.

We are not responsible for losses caused by your failure to safeguard your account credentials.

4. Authentication

You may create an account using:

  • email and password; or

  • Google Sign-In.

If you use a third-party authentication provider, you authorize us to receive information made available by that provider according to your settings.

Your relationship with those providers is governed by their own terms and privacy policies.

5. User Content

You retain ownership of the content you upload to alike, including:

  • text;

  • images;

  • videos;

  • files;

  • product listings;

  • branding;

  • logos;

  • domain settings; and

  • other materials (“User Content”).

You are solely responsible for your User Content.

You represent that:

  • you own or have permission to use it;

  • it does not infringe any intellectual property rights;

  • it complies with applicable laws; and

  • it complies with these Terms.

6. License You Grant Us

To operate the Service, you grant Off Diary Limited a worldwide, non-exclusive, royalty-free license to:

  • host;

  • store;

  • reproduce;

  • modify for technical purposes;

  • distribute;

  • display; and

  • transmit

your User Content solely for the purpose of operating, maintaining, improving, and providing the Service.

This license ends within a commercially reasonable period after your content is permanently removed from the Service, except where copies must be retained for backups, legal obligations, fraud prevention, or security purposes.

7. Public Content

Pages you publish are intended to be publicly accessible unless otherwise indicated.

Information displayed on public pages may be:

  • indexed by search engines;

  • cached by third parties;

  • shared by visitors; and

  • archived outside our control.

Removing content from alike does not guarantee its removal from third-party services.

8. Acceptable Use

You agree not to use alike to:

  • violate any law or regulation;

  • infringe intellectual property rights;

  • impersonate another person;

  • distribute malware;

  • engage in phishing or fraud;

  • send spam;

  • promote illegal activities;

  • exploit or abuse minors;

  • publish hateful or discriminatory content;

  • distribute viruses or malicious code;

  • interfere with the operation of the Service;

  • scrape or harvest user data without authorization;

  • attempt unauthorized access to systems or accounts;

  • circumvent security measures; or

  • use alike in any way that could damage the platform or other users.

9. Prohibited Content

You may not upload or publish content that:

  • is unlawful;

  • contains child sexual abuse material;

  • promotes terrorism or violent extremism;

  • contains malware;

  • infringes copyright or trademarks;

  • is defamatory;

  • is fraudulent;

  • promotes scams;

  • contains non-consensual intimate imagery;

  • violates privacy rights; or

  • violates applicable laws.

We may remove content at our sole discretion.

10. Intellectual Property

All rights in alike, including its software, design, branding, source code, graphics, documentation, and functionality, belong to Off Diary Limited or its licensors.

These Terms do not grant you ownership of the Service.

You receive only a limited, revocable, non-transferable license to use alike in accordance with these Terms.

11. Copyright Complaints

If you believe content hosted on alike infringes your copyright, please contact:

Your notice should include:

  • identification of the copyrighted work;

  • identification of the allegedly infringing material;

  • your contact information;

  • a statement of good faith belief; and

  • a statement that your notice is accurate.

We may remove allegedly infringing content while investigating.

12. Selling Products

Users are solely responsible for:

  • products they sell;

  • pricing;

  • taxes;

  • refunds;

  • shipping;

  • customer support;

  • legal compliance.

Off Diary Limited is not the merchant of record unless expressly stated.

We do not guarantee the quality, legality, safety, or delivery of products sold through alike.

13. Payments

Paid subscriptions and payment processing are handled through Stripe.

By purchasing a subscription, you authorize recurring charges until cancellation.

Prices may change in the future.

Price changes will not affect existing billing periods until renewal.

Failure to pay may result in suspension or termination of paid features.

14. Subscription Cancellation

You may cancel your subscription at any time.

Cancellation prevents future renewals.

Except where required by law, subscription fees already paid are non-refundable.

Access to paid features continues until the end of the current billing period.

15. Taxes

You are responsible for any taxes associated with your sales or use of the Service.

Where required, we may collect taxes on subscriptions in accordance with applicable law.

16. Custom Domains

You remain responsible for:

  • registering your domain;

  • maintaining DNS records;

  • complying with registrar requirements.

We are not responsible for domain expiration, registrar disputes, or DNS outages.

17. Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability.

The Service may occasionally become unavailable because of:

  • maintenance;

  • security updates;

  • third-party failures;

  • internet outages;

  • force majeure events.

18. Third-Party Services

The Service relies on third-party providers including payment processors, hosting providers, analytics providers, email providers, authentication providers, and domain infrastructure providers.

We are not responsible for failures caused by third-party services beyond our reasonable control.

19. Feedback

If you submit suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without compensation.

20. Suspension and Termination

We may suspend or terminate your account if:

  • you violate these Terms;

  • your use creates legal or security risks;

  • payment fails;

  • we are required by law;

  • continuing to provide the Service is commercially impractical.

You may stop using alike at any time.

Termination does not affect obligations that survive termination.

21. Data Retention

Following account closure, we may retain certain information where necessary for:

  • legal obligations;

  • dispute resolution;

  • fraud prevention;

  • security;

  • backup restoration.

22. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, Off Diary Limited disclaims all warranties, express or implied, including warranties of:

  • merchantability;

  • fitness for a particular purpose;

  • non-infringement; and

  • uninterrupted availability.

We do not warrant that the Service will always be secure, error-free, or uninterrupted.

23. Limitation of Liability

To the fullest extent permitted by law, Off Diary Limited and its directors, officers, employees, and affiliates shall not be liable for:

  • indirect damages;

  • incidental damages;

  • consequential damages;

  • special damages;

  • loss of profits;

  • loss of revenue;

  • loss of goodwill;

  • loss of data;

  • business interruption.

Our total liability arising from the Service shall not exceed the greater of:

  • the fees paid by you during the twelve months preceding the claim; or

  • USD $100.

Nothing in these Terms excludes liability that cannot legally be excluded.

24. Indemnification

You agree to indemnify and hold harmless Off Diary Limited from claims, damages, liabilities, losses, costs, and expenses arising out of:

  • your use of the Service;

  • your User Content;

  • your products or services;

  • your violation of these Terms; or

  • your violation of applicable law or third-party rights.

25. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, war, labor disputes, governmental actions, cyberattacks, or failures of third-party infrastructure.

26. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, excluding its conflict of law principles.

Any dispute arising out of these Terms shall be submitted to the courts of Hong Kong, unless applicable law provides otherwise.

27. International Users

The Service is available worldwide.

You are responsible for complying with the laws applicable in your jurisdiction.

Nothing in these Terms limits rights that cannot be waived under applicable consumer protection laws.

28. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we will provide reasonable notice through the Service or by email where appropriate.

Continued use of alike after revised Terms become effective constitutes acceptance of the updated Terms.
